Article 1. GENERAL PROVISIONS AND DEFINITION OF PERSONAL DATA

The website http://www.stehlin-legal.com/fr (hereinafter the “Website”) is designed, managed and operated by Stehlin & Associés law firm (the “Firm”), whose head office is located at 48 Avenue Victor Hugo, 75116 Paris.

By using the Website you (hereinafter “You” or the “Users“) expressly accept the collection and processing of your personal data, as described in this privacy policy (the “Privacy Policy“).

Personal data (hereinafter “Personal Data”) are considered any information relating to an identified or identifiable person (hereinafter referred to as “Person Concerned”). Is deemed to be an “identifiable person” a person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more specific elements specific to their physical, physiological, genetic, psychic, economic, cultural or social identity.

The present Privacy Police defines how the Firm generally collects and processes its clients’ Personal Data.

The Firm is highly attentive to respecting your private life and the confidentiality of your Personal Data. In order to respect and protect your privacy and the confidentiality of your Personal Data, the Firm undertakes to collect and process your Personal Data in compliance with applicable laws and regulations, and in particular the modified Act no. 78 -17 dated January 6, 1978 on Information Technology, data files and civil liberties (hereinafter the “IT Law”) and the EU General Regulation (EU) 2016 / 679  on the protection of personal data (“GDPR“) of the European Parliament and European Council of 27 April 2016 and the European Convention No. 108 on the protection of individuals with regard to the processing of personal data and on the freedom circulation of their data (hereinafter the “Regulations“).

Article 2. PERSON RESPONSIBLE FOR THE PROCESSING OF PERSONAL DATA

Your Personal Data collected is processed by the Firm as data controller (hereinafter the “Data Controller“).

The Firm complies with all French and European regulatory and legislative provisions relating to the protection of Personal Data.

Article 3. COLLECTED PERSONAL DATA

We collect and process Personal Data with respect to :

  • Users of the Website,
  • Clients or contacts,
  • People visiting our offices or attending our events,
  • Potential candidates during a recruitement process,
  • Former associates of the Firm or members of our Alumni Programme, and
  • Subcontractors and third party services providers, correspondant law firms, legal counsels, legal specialists, experts and consultants (notaries, mediators or arbitrors), accountants or auditors, regulators, courts and law enforcement agencies.

As part of its activity, the Firm is likely to collect Personal Data directly from Website Users whenever they:

  • Subscribe to a newsletter (hereinafter the “Newsletter“) from the Firm, in order to receive the various press releases published by the Firm,
  • Apply for a position or an internship, or
  • Fill in the contact form in order to receive more information on the Firm.

When registering to our Newsletter, or when addressing the Firm messages via the contact form provided on the Website, or applying for a position / internship in the Firm, the following Personal Data is collected:

  • Last name,
  • First name,
  • Address,
  • Email address, and
  • Telephone number.

As a rule, the Website is intended to be browsed by adults capable of entering into obligations in accordance with the legislation of the country in which the Users are located.

Users under the age of 15 or incapacitated must obtain the prior consent of their legal representative before entering their Personal Data on the Website.

Certain Personal Data collected is compulsory in view of allowing the Users to benefit from the services offered on the Website, and in particular as specified above, in the absence of consent, Users will not be able to subscribe to the Newsletter and / or send emails via the Website.

Concerning the Newsletter subscription, Users may, at any time, terminate their subscription, by clicking on the unsubscribe link provided in each of our communications, or by contacting the Firm in the manner described in Article 10 below.

While navigating the Website, the Firm is likely to collect information relating to the devices used by the Users or to the networks from which they access the Website (type of terminal, operating system, browser, access provider, terminal IP address, terminal geolocation data), as well as connection data for statistical purposes (date, time, protocol of the visitor’s computer, consulted pages).

Among the technologies used to collect this information, the Firm notably uses cookies detailed more precisely in Article 10 below.

When attending to meetings in our premises or to external events and meetings the Firm is likely to collect and process Personal Data such as :

  • Last name,
  • First name,
  • Email adress,
  • Adress,
  • Telephone number,
  • Identification documents, and
  • Special dietary requirements or personal preferences.

The Firm uses Sarbacane e-mailing system in order to deliver our clients mass emails (invitations, briefings, newsletters, corporate information). The Firm collects Personal Data and cookies when using Sarbacane, in order to track the links sent and provide information with respect to the time our content is viewed, clicked-on, opened, deleted and / or replied to.

The Firm also collects Personal Data with respect to its third party contacts:

  • Last name,
  • First name,
  • Address,
  • Email address,
  • Telephone number,
  • Identification documents, and
  • Billing information.

Article 4. DURATION OF RETENTION OF YOUR PERSONAL DATA

With respect to Personal Data collected and managed after subscribing the Newsletter, Personal Data is managed for as long as the User does not unsubscribe via the unsubscribe link integrated into the Newsletter. Without any instructions or interaction over a period of
three (3) years, the Personal Data is deleted from our records, in accordance with the RGPD legal requirements.

Data relating to statistics and audience measurements, the information stored in the Users terminal or any other element used to identify Users and allowing their traceability or frequentation will not be kept beyond thirteen (13 months) before being archived to meet our legal obligations.

Article 5. PURPOSE

Your Personal Data is collected and processed for the purpose below:

  • Provide you with the services or information you have requested,
  • Answer your questions and requests, and
  • Ensure the processing of the applications received.

The processing of your Personal Data is based on the legitim interest of the Firm.

In addition, your Personal Data may also be processed in order to:

  • Ensure the functioning and security of the Website, improve its functioning and adapt it to your requests,
  • Carry out anonymized statistical calculations.

These treatments are based on the legitim interest of the Firm to ensure proper functioning and security of the Website, as well as evaluation and analysis of its audience.

The Firm may also use your Personal Data for communication purposes in view of sending Users its newsletters, information and invitations to events and conferences.

This processing is based on the legitim interest of the Firm to develop its clients relationship, prospects and partners.

Article 6. RECIPIENTS OF PERSONAL DATA

The Personal Data collected is reserved for the exclusive use of the Firm and cannot be communicated to third parties, excepted: subcontractors and third party services providers, correspondant law firms, legal counsels, legal specialists, experts and consultants (notaries, mediators or arbitrors), accountants or auditors, regulators, courts and law enforcement agencies.

Article 7. TRANSFER OF PERSONAL DATA

The Personal Data collected is hosted in the European Union and is stored in the European Union.

The Firm may share your Personal Data, for communication purposes or other legitime reasons, with its business partners located in France or outside the European Union, whose list can be found on the Firm’s Website in the Partnerships and International Network tab.

The transfer of your Personal Data outside the European Union is governed by a data transfer contract based on the standard contractual clauses of the European Commission.

Whenever Personal Data is disclosed to us from a third party, the responsability of the Personal Data lies on the disclosing party.

Article 8. EXERCISE OF YOUR RIGHTS

In accordance with applicable law and the regulations in force, you have the right to access, rectify, oppose, erase and portability of your Personal Data. As such, you can rectifie, complete, update or delete all Personal Data that is inaccurate, incomplete, or outdated. You can as well, at any time and without reason, oppose the processing of your Personal Data for communication purposes.

Should you encounter any difficulties related with the management of your Personal Data, you can address the Firm or the CNIL (National Commission for Information Technology and Liberties – www.cnil.fr, 3 Place de Fontenoy, 75007 Paris) a written complaint.

Article 9. SECURITY MEASURES

The firm implements all required measures intended to ensure the security and protection of the Site and thus protect your Personal Data against any access by unauthorized third parties.

Your Personal Data is protected by technical and organisational measures in accordance with French and European legal and regulatory requirements, ensuring their security, integrity and confidentiality.

In particular, the Firm uses protection technologies, such as encryption, authentication and fraud detection systems to protect databases.

The firm commits that its service providers offer all necessary guarantees in order to ensure the protection of the Personal Data whose processing is entrusted to them.

Article 10. COOKIES

Cookies and tracers are small text files, often encrypted, stored in your browser. They are created when a user’s browser loads a given website, the site sends information to the browser, which then creates a text file.

When Users browse our Website, the Firm may collect and store certain information related to their visit for a maximum period of 13 months, using technical cookies:

  • Name of the computer used,
  • IP address of the computer used,
  • Visted pages,
  • Date, time and duration of navigation, and
  • URLs through which Users have passed to reach our site

We use this information to:

  • Analyse and measure Website traffic,
  • Render the Website more functional, and
  • Remember your language

The firm does not use advertising cookies. However, if the Firm were to use them in the future, Users would be able to deactivate these cookies.

The Users’ browser is probably configured to accept cookies. However, Users can modify their browser settings and refuse all or part of cookies used, or to delete them. Users can oppose the cookies tracking by configuring their browser.

Please note, however, that certain features are not accessible if Users deactivate the use of cookies by the Website.

Article 11. MODIFICATION OF OUR PRIVACY POLICY

We reserve the right to modify this Privacy Policy, in whole or in part, at any time. These changes will take effect as of the publication of the new Privacy Policy.

Any modification or update by us of the revised Privacy Policy will be published online on the Website with mention of the last date of update. Therefore, we invite you to regularly check our Website in order to stay informed of any change or update of the Firm’s Privacy Policy.

In any event, your use of the Website following the entry into force of these modifications will constitute recognition and acceptance of the new Privacy Policy.
